Horse Sale Disclaimer (Texas)

The information provided on this website is for general informational purposes only and applies to horses offered for sale private treaty and/or through auction by M Bar W, LLC and M Bar W Ranch (“Seller”). By viewing, inquiring about, or purchasing a horse from this site, M Bar W, LLC ANd M BAr W Ranch, you acknowledge and agree to the following:

1. No Warranties or Guarantees

All horses are sold “AS IS, WHERE IS”, with no warranties, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, soundness, disposition, performance, or future athletic ability.
Unless expressly stated in a written agreement signed by Seller, M Bar W, LLC and M Bar W Ranch make no guarantees regarding a horse’s health, training level, breeding quality, fertility, or suitability for any specific use.

2. Buyer’s Responsibility for Due Diligence

Buyers are strongly encouraged to perform their own pre-purchase examinations, including but not limited to veterinary evaluations, radiographs, reproductive exams, drug screening, and any other inspections deemed necessary.
Failure to conduct due diligence is solely the responsibility of the buyer.

3. Representations and Descriptions

Descriptions, photos, videos, pedigrees, and statements regarding each horse are provided to the best of Seller’s knowledge but are not guaranteed to be error-free.
M Bar W, LLC and M Bar W Ranch are not liable for inaccuracies, omissions, or interpretations of any kind.

4. Texas Law & Liability

All sales conducted through this website or otherwise by M Bar W, LLC and M Bar W Ranch are governed by the laws of the State of Texas, and any disputes shall be resolved exclusively in the appropriate Texas jurisdiction.

Under Texas Equine Activity Liability laws (Texas Civil Practice & Remedies Code § 87.001 et seq.), Seller is not liable for injuries or damages resulting from the inherent risks of equine activities.

WARNING
Under Texas Law (Chapter 87, Civil Practice and Remedies Code), an equine professional and a livestock activity sponsor are not liable for an injury to or the death of a participant in equine or livestock activities resulting from the inherent risks of such activities.

5. Private Treaty Sales

Terms, prices, and availability of horses offered private treaty are subject to change at any time without notice.
A horse is not considered sold until a written purchase agreement is executed by both parties and funds have cleared.

6. Auction Sales

For horses sold at auction, all bidding rules, buyer terms, payment requirements, and conditions of sale imposed by the auction company or platform shall apply and may supersede this disclaimer where applicable.
